5 Year Product Replacement Guarantee
for AGB-WT and AGB-BT, both with traceability

AggreBind Inc. technology holder and manufacturer with Production Partners (hereinafter referred to as the “Manufacturer”) of AGGREBIND, AGB-WT and AGB-BT (hereinafter referred to as the “Product”), do hereby undertake to supply free of charge any of the styrene acrylic co-polymer Product that is proven to have chemically failed in the first 5 years after the installation of Product by a trained installer, being installed for general automobile and commercial truck usage, due to a defect in the Product, subject to the following Terms and Conditions:

1. The Product must be stored in accordance with the Manufacturer’s instructions, readily identified on each tote, which includes being properly agitated or stirred prior to use. Product, while in its liquid form, should not be subjected to freezing temperature prior to the installation or exposed to excessive temperatures (40°C+), or being applied where temperatures below zero will occur within a 24-hour period after installation.
2. The Product must be installed within 12 calendar months of being supplied.
3. The suitability of the Product for an application/installation shall be in accordance with the published parameters of the Manufacturer, i.e. 35% fines content passing through a #200 sieve with no rocks or stones exceeding 20% of the depth and a Plasticity Index of 15 or below. An independent qualified engineering specification for granulometry (sieve analysis) and Atterberg Limits Test (plasticity analysis) is required. Concerns about drainage and water runoff must be addressed prior to the installation of the Product. This information is to be communicated to the Manufacturer prior to the installation. If clarification is needed, contact the Manufacturer.
4. The materials or surfaces to be applied shall be free of any contaminates either embedded in or on the surface, or incompatible minerals or physical state (e.g. Radiation) unless these have the prior written approval of the Manufacturer.
5. The Product shall not be diluted with any contaminated water without the prior written approval of the Manufacturer.
6. No other additives of any nature shall be added to the Product.
7. The Product shall not be deemed to have failed if the treated layer or surface is subjected to penetration or exposure to or by corrosive or other deleterious chemicals or environments to styrene acrylic co-polymers.
8. The Product shall not be deemed to have failed if it is not installed in accordance with the engineering specification and the Manufacturer’s instructions.
9. The Product shall not be deemed to have failed if there has been surface damage such as erosion from water run-off, poor drainage, damage from the ingress of standing water because of insufficient pitch in the road or area, high water table, potholes, unattended wear & tear and such, and there has been no attempt by the customer to execute reasonable & customary maintenance repairs to the damaged area, and the customer has not contacted the Manufacturer for guidance on how to repair such a condition.
10. The Manufacturer will not be liable where Products are exposed to Ultra Violet values of above 60 Kilo Langleys. (Specific Product formulations may exceed this value for which the Manufacturer may at their discretion increase the UV value for individual Products/projects/application.)
11. The Manufacturer will not be liable, in any way, for the work (labor charge) carried out by the Contractor installing or applying the Product or effecting repairs.
12. The Manufacturer will not be responsible for any Product damaged in transit from the warehouse to the client.
13. The Product will not be deemed to have failed if subjected to sabotage, flooding, earthquakes, typhoons, mining subsidence, fire, war or any other event that can be defined as an act of God.
14. The Product is manufactured to ISO9001 standards and is subject to verified batch sampling, prior to dispatch, to ensure that the Product supplied is of good quality.
15. Where applicable, the Product with the soil or surfaces shall have been laboratory tested and analyzed for composition and make up and test soil or surface samples produced and tested to ensure a ‘control’ is established for subsequent on-site validation checks executed by an engineer. When it is an installation of 10 km or greater, we recommend the customer use the Manufacturer’s Memorandum of Responsibilities document as a job-management tool.
16. For this guarantee to be applicable, an independent qualified engineer, acceptable to both parties, shall provide certification that all design specifications, soil and surface analysis, laboratory tests and field site-quality assurance tests have been complied with and that a full and detailed documentation audit trail of quality assurance exists from receipt of Product through to completion of installation.
17. This guarantee excludes “wear, tear, abrasion and penetration” of installed Product or excessive pressure over and above the Product specification caused by usage or incorrect Product selection and/or application suitability.
18. EXCEPT AS EXPRESSLY PROVIDED HEREIN, THE MANUFACTURER MAKES NO OTHER REPRESENTATIONS OR WARRANTIES OF ANY KIND TO BUYER, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR ANY WARRANTY OF NON-INFRINGEMENT. FURTHERMORE, UNDER NO CIRCUMSTANCES SHALL MANUFACTURER BE RESPONSIBLE FOR INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE OR ANY ACTS OR OMISSIONS ASSOCIATED THEREWITH OR RELATING TO THE USE OF ANY ITEMS OR SERVICES FURNISHED, WHETHER SUCH CLAIM IS BASED ON BREACH OF WARRANTY, CONTRACT, TORT OR OTHER LEGAL THEORY AND REGARDLESS OF THE CAUSES OF SUCH LOSS OR DAMAGES OR WHETHER ANY OTHER REMEDY PROVIDED HEREIN FAILS.
19. This guarantee is strictly limited to the free replacement of Product at our works in either the US, India or other production facility of our choosing.
20. This guarantee becomes effective on acceptance of the Product by the purchaser and that the specifications and requirements of this guarantee have been agreed to and complied with.
21. For this guarantee to be applicable a Pre-Installation Evaluation Form must be completed, submitted, and accepted in writing by AggreBind Inc. The Pre-Installation Evaluation Form can be found on the Manufacturer’s website www.aggrebind.com or requested directly from AggreBind Inc.
